Matter is taken up today on an application moved by the accused.
Present: Ms. Sanju Gupta, Ld. Counsel for the accused along with accused.
An application for cancellation of NBWs has been received on the ground that
the accused has lodged an FIR in another matter and got busy in the court proceedings of
that matter in Siliguri and forgot to appear before this court, hence could not appear before
this court on the LDOH. Submissions heard and record perused.
Accused undertakes that he shall appear on each and every date in future. Ld.
counsel also gives his undertaking to let the accused appear on each and every date in
future. Heard.
Taking a lenient view in the present matter and in view of the submissions
made, NBWs issued against the accused Ramshis Prasad are hereby stayed till NDOH.
Let copy of this order be also sent to concerned SHO for intimation and
compliance and SHO is also directed to return the process to the court. Dasti allowed.
Put up for purpose fixed on the date already fixed i.e. 24.07.2024.
PA is directed to do updation of the case and upload the order as per rules.
