Present: Sh. Rajendra Singh Chauhan, Ld. counsel for the complainant along with
complainant.
Perusal of the case documents reflects that the bank details of the complainant
is nowhere mentioned in the documents. Upon raising a query, complainant submits that he
maintains his bank account at SBI, Ram Nagar, Uttarakhand.
At this stage, he submits that the account has been transferred to SBI,
Barakhamba Road, New Delhi. He is directed to file the current bank passbook/any other
document in support of his claim by the NDOH.
Further, the present complaint is barred by limitation. The condonation
application is already on record.
Notice of the application be issued to the proposed accused. Proposed accused
is directed to appear in person/through counsel on the NDOH. He is at liberty to file a reply
to the application of complainant. In case the proposed accused fails to appear, the
application shall be decided on merits.
Complainant is directed to file a copy of the said application with the Ahlmad
of court within 3 days from today.
Put up for report/appearance of proposed accused and arguments on
application on 23.12.2022.
PA is directed to do updation of the case and upload the order as per rules.
