Pr: Ms Saumya Chopra Ld Counsel for the complainant.
None for the accused.
Ld. counsel for the complainant submits that he has filed an application for waiver
of previous cost on the email ID of the court. Same be taken on record.
Heard.
In view of the submission made and in the interest of justice the cost imposed on the
complainant on the LDOH stands waived.
Ld. counsel for the complainant submits that she has filed the tracking report of the
delivery of the summons on the e-mail ID of the court. Same be taken on record.
Physical copy of the same be furnished within due time.
Reader is directed to upload the same on LAYERS as per rules.
Perusal of the tracking report shows that summons are duly served on the accused
no.1,2 and 3 . Despite service, none appeared on behalf of accused. It appears that accused is
deliberately/intentionally not appearing before this court.
Accordingly, issue BWs against accused no 2 and 3 in sum of Rs. 20,000/- with
one surety through SHO concerned, on filing of PF by the complainant within 7 days,
returnable for the NDOH.
The concerned SHO is directed to effect the service of the warrants positively by
atleast making 3 attempts for executing the same.
Ld. counsel for the complainant submits that he has filed the fresh address of the
accused no. 4 on the email ID of the court. Same be taken on record.
Fresh summons be issued against accused no .4 in terms of the last order through
all modes upon filing of PF within 07 days. Complainant is directed to get the service of the
summons done at his end also through all permissible modes. Dasti summons allowed.
Put up for report/appearance of accused and further proceedings on 08.06.2026.
PA is directed to do updation of the case and upload the order as per rules.
