There is pendency of more than 41,000 cases in the present court, therefore, it is not
possible to give shorter date in the cases.
Matter was earlier received by way of transfer.
Present : Mohd. Arshad, Ld. Counsel for complainant through
VC (presence marked in recall)
On merits, matter was pending for furnishing service
report of legal demand notice.
Physical file deposited.
At the stage of consideration on summoning, legal
demand notice returned with the comment ‘insufficient address’
is deemed to have been served upon the accused. The same is
sufficient compliance for consideration at the stage of
summoning.
As per CIS filing has been effected on 20.4.23.
Prima-facie, this complaint appears to be barred by
limitation.
At this stage, Ld. Counsel for complainant has
entered appearance in recall and submits that the accused has
expired. Even though, there is no locus of the accused at this
stage since the matter is at the stage of pre cognizance, in terms
of submission made by Ld. Counsel for complainant, issue court
notice (Without PF) to the SHO concerned to verify the factum of
the death of the accused and file a report in this regard on the
NDOH.
Let an application seeking condonation of delay be
filed/ report on death verification of accused on 15.01.27.
Complainant is directed to furnish all the previous
ordersheets in the matter.
