Matter is taken up today on an application moved by the accused.
Present: Mr. Richik Harikant, Ld. Counsel for the accused along with accused.
An application for cancellation of NBWs has been received on the e-mail ID
of the court. Same be taken on record.
It is stated that accused could not appear on LDOH as he was attending the
last rites of his uncle. He has filed death certificate with the application. Ld. counsel for
the accused submits that he was under the impression that matter was fixed for 2 PM, hence
he also failed to appear on LDOH. Accused undertakes that he shall appear on each and
every date in future. Ld. counsel also gives his undertaking to let the accused appear on each
and every date in future.
In view of the undertaking, NBWs stands cancelled. The application is hereby
disposed off.
Let copy of this order be also sent to the concerned SHO for intimation and
compliance. SHO is also directed to return the process to the court.
Put up for purpose already fixed and date already fixed, i.e. 11.01.2024.
PA is directed to do updation of the case and upload the order as per rules.
