Ld. Counsel for accused submits that they have filed a Writ Petition in the
Hon’ble High Court of Delhi challenging the summoning order dated 18.08.2023, on
which notice has been issued and the NDOH is 23.02.2026.
Ld. Counsel for complainant submits that even after being given
sufficient time, the accused has stretegically moved the petition in August and the
copy of the same has been supplied on 18.09.2025. Ld. Counsel for complainant
further submits that no stay has been granted by the Hon’ble High Court of Delhi.
Heard and record perused.
It is clear from the order produced by the Ld. Counsel for the accused
passed in the Writ Petition challenging the summoning order that no stay has been
granted. However, the matter of jurisdiction goes to the root of the matter and this
court deems appropriate to wait for the result of the writ petition filed by the Ld.
Counsel for the accused in the Hon’ble High Court of Delhi.
Accordingly, put up for further proceedings on 24.02.2025.
