behalf of the accused no.2 M S Arora .

Arora.
An application for cancellation of process U/s 82 Cr.PC has been moved on behalf
of the accused No.2 M S Arora.
It is submitted that due to tehcnical reasons the accused could not join the proceedings on
time and hence could not apper before the court as a result of which proces U/s 82 Cr.P.C was issued
against the accused.
The accused undertakes to be present in the court on each and every date of hearing.
Submissions heard.
Although, this court is not convinced with the reasons put forth for the non-appearance of
the accused during the case proceedings, however, taking a lenient view and considering the
submissions made in court today, process U/s 82 Cr.PC issued against the accused No.2 M S Arora
are hereby cancelled subject to cost of Rs. 5000/- to be paid to the complainant, with a direction to
the accused to remain present on each and every date of hearing.
Since the offence u/s. 138 NI Act is bailable in nature, the accused is hereby released
on bail on furnishing of personal bond in the sum of Rs. 40,000/- with one surety of like amount.
The counsel for accused request for sometime to furnish the same . Heard and allowed
subject to furnishing of the same within 10 days from today.
Accused is directed to produce a sound surety on the NDOH.
Put up for furnishing of surety bond on date already fixed i.e. 12.03.2026
Copy of this order be given dasti to the applicant/accused, as prayed for.
PA is directed to do updation of the case and upload the order as per rules.
