Sh. Abdul Karim Saifi, Ld. proxy counsel for accused.
The matter is listed for framing of notice.
On LDOH, accused was directed to be present in
person along-with surety. Despite directions, accused has not
appeared. Perusal of record shows that proceedings u/s 82 Cr.P.C
were cancelled against the accused subject to cost.
Application for waiver of cost filed by Ld. counsel for
accused. As the accused has not appeared today also, application is
dismissed.
This Court is of the opinion that the accused is
concealing himself. In view of the same, issue process U/s. 82
Cr.P.C against the accused, through DCP concerned on filling of PF
within 07 days. Process server is directed publicly read the
proclamation in the vicinity in which the accused ordinarily resides;
one copy of the process be also affixed to some conspicuous part of
the house or to some conspicuous place of such town or village
where the residence of accused is located and one copy of the

process be also affixed on the notice board of the Court /
conspicuous part of the Court premises.
Process server who will execute the process U/s. 82
Cr.P.C shall remain present in person before the Court on NDOH for
recording his statement.
Put up for appearance of accused on 23.11.2026.
