the accused and accused has made the payment of settled amount
accordingly to the complainant and he on behalf of the complainant
wants to withdraw the present case as settled being duly authorized for
the same.
Statement of Counsel for complainant qua withdrawal of the case is
separately recorded.
In view of the statement of counsel for complainant, present matter
stands disposed off as withdrawn/ settled being compounded and accused stands
acquitted.

Today, the undersigned is looking after the work of Ld. Link JMFC.
Present : Sh. Amit Mahaliyan, Ld. Counsel for the
complainant.
Perusal of the present complaint reveals that the
present complaint has been filed after coming into force of
Bhartiya Nagarik Suraksha Sanhita, 2023. Therefore, Bhartiya
Nagarik Suraksha Sanhita, 2023 shall apply on the complaint.
Perusal of the record further shows that the present complaint has
been filed within limitation, however, as per Section 223 of
Bhartiya Nagarik Suraksha Sanhita, 2023, cognizance of the
offence cannot be taken without giving the accused an
opportunity to be heard.
Accordingly, issue C/N to the proposed accused to
appear before this court and argue on the point of cognizance on
filing of PF within 2 weeks from today through all permissible
modes, returnable on 11.09.2025.
