Present: Sh. Neeraj Anand, Ld. counsel for the complainant along with complainant.
Sh. Samir Bhatnagar, Ld. counsel for the accused.
Matter is fixed for CE at 2 PM.
Ld. counsel for the accused submits that the previous counsel has left the
office and he does not have access to the case file. He requests for an adjournment.
It is noted that despite giving last and final opportunity, accused has still not
furnished the surety bonds. No reason is forthcoming for the same as well as for the absence
of the accused today. Further, no sound reasoning is forthcoming for the adjournment.
Hence, accused is imposed a cost of Rs. 1000/- to be paid to the complainant forthwith.
Ld. counsel for the accused requests for time till NDOH to pay the cost since
the accused is not available. Heard and considered for today only.
It is to be noted that in case of further default, adverse view shall be taken
against the accused on the NDOH. Further, last and final opportunity is granted to the
accused to cross examine the complainant, failing which right shall stand closed.
At this stage, Ld. counsel for the complainant has filed an application u/s
143A NI Act. Copy supplied to the opposite side. Reply, if any be filed by the NDOH.
Put up for purpose fixed and arguments on application on 06.06.2023 at 2
PM.
PA is directed to do updation of the case and upload the order as per rules.
