counsel for complainant alongwith complainant.
ATR not filed. A reply has been filed by SI Sunil Sharma. In the reply, it
is mentioned as follows:
"It is submitted that the present matter is listed for today for filing of
Action Taken Report (ATR) in compliance of the directions of the
Hon'ble Court. It is further submitted that the SHO/ CP is presently on
leave, due to which the ATR could not be finalized and filed today due to
aforesaid circumstances."
Perusal of the record shows that vide order dated 03.02.2026 the court
had ordered for preservation of CCTV footage as well as filing of ATR.
A query is put to the Naib Court regarding leave of the SHO, to which
he has replied the SHO is on leave from 22.04.2026 to 27.04.2026. I am dismayed
by the fact the ATR is not filed and the reasons for not filing the ATR is 'leave of the
SHO'.
Let ATR be filed by NDOH duly forwarded by DCP New Delhi.
Further, SHO is directed to file an explanation properly explaining why
ATR was not filed.
List the matter for now on 07.05.2026.
