An application for cancellation of NBWs has been received on the ground that the accused had no
knowledge about the non representation by the counsel on the LDOH and was also not well. Medical
documents have been attached therewith. He thus could not appear before this court on the LDOH.
Submissions heard and record perused.
Accused undertakes that he shall appear on each and every date in future. Ld. counsel also gives his
undertaking to let the accused appear on each and every date in future. Heard.
Taking a lenient view in the present matter and in view of the submissions made, NBWs issued
against the accused A P Venkat are hereby stayed till the NDOH . Cost of Rs.3000/- be paid by the accused
to the complainant forthwith.
Accused is directed to file personal bonds in the sum of Rs. 40,000/- forthwith.
Accused undertakes to file surety bonds in the same amount by NDOH. Surety to appear on NDOH.
Let copy of this order be also sent to concerned SHO for intimation and compliance and SHO is also
directed to return the process to the court. Dasti allowed.
Put up for purpose fixed on the date already fixed i.e. *29.01.2025.
PA is directed to do updation of the case and upload the order as per rules.
