of heavy pendency.
Present: Sh. Rishabh Kumar Jha, Ld. Counsel for complainant.
File received by way of transfer from the Court of Ld. JMFC, NI Digital-03,
PHC, NDD, ND.
Perusal of record shows that the file is not complete and the previous order
sheets have not been annexed with the file.
Ahlmad concerned is directed to produce the complete file with order sheets
before this court on the NDOH.
The complainant is directed to assist the Ahlmad concerned with the
completion of records.
Ld. Counsel for Kotak Mahindra bank (proposed complainant) is present
before this court today. Ld. counsel has filed an application for substitution of AR and
counsel stating that by virtue of an assignment agreement made between complainant and
Kotak Mahindra Bank, the proposed complainant has got all the rights and liabilities
pertaining to the loan account in question in the instant case. The said application is
appended with copy of Board Resolution in favour of the proposed AR as well as fresh
vakalatnama on behalf of Ld. Counsel. Taken on record.
The present application is allowed and Sh. Sujit Singh is substituted as AR in
place of previous AR.
Ld. Counsel for complainant has filed the amended memo of parties as well
as fresh evidence by way of affidavit. Same is taken on record.
Accordingly, the proposed complainant i.e. Kotak Mahindra Bank is hereby
substituted as the complainant in the matter.
Ahlmad concerned is directed to do the needful and make necessary changes
in the name of the complainant.
Perusal of record shows that the e-filing history is not on record.
Put up for filing of e-filing history on 07.11.2028.
