Present: Sh. Deepak Garg, Ld. Counsel for complainant alongwith complainant.
None for accused.
Summons issued vide last order received back with the report unserved
as it is stated in the report that the door of the house was not opened despite repeated
efforts.
Further, Ld. Counsel for complainant has sent proof of Whatsapp service
of summons on the email ID of this court alongwith certificate u/s 65B Indian
Evidence Act. The digital copy of the document is taken on record. Let the physical
copy be filed within due time. Perusal of the document reveals that summons are duly
served on the accused through Whatsapp.
It appears that the accused has the knowledge of the court proceedings
and is deliberately avoiding the service of summons.
Accordingly, issue BWs against the accused in the sum of Rs.10,000/-
with one surety of like amount through the SHO concerned returnable for the NDOH.
PF be filed within 15 days.
Put up for report on Bws/appearance of accused on 08.07.2024.
PA is directed to upload the orders as per rules.
