Matter is taken up today upon an application moved by the accused No.3
Present: Mr. Shankar Chhabra, Ld. counsel for the accused No.3 along with
accused No.3.
An application for cancellation of NBWs received on the e-mail ID of
the court. Same be taken on record.
Fresh vakalatnama on behalf of accused No.3 and medical reports are
also attached with the application. Same be taken on record.
It is stated that the accused was having Covid Symptoms due to which he
could not appear on the last date of hearing. That the accused also tried to join the
proceedings, however, due to connectivity issues and his lack of ability to understand
the technicalities of virtual hearing, he could not join the proceedings.
Ld. counsel submits that he is newly engaged in the present matter and
was unaware about the last date of hearing.
Accused undertakes that he shall appear on each and every date in future.
Ld. counsel also gives his undertaking to ensure the presence of accused in future.
Last and final opportunity is granted to the accused. In case of default in
future, Bail bonds (already on record) shall be forfeited.
In view of the reasons stated and undertakings, NBWs stands cancelled.
Application is hereby disposed off.

Ld. copy of this order be also sent to the concerned SHO for intimation
and compliance. SHO is also directed to return the process to the court.
Put up for purpose already fixed and date already fixed, i.e. 18.05.2022.
PA is directed to do updation of the case and upload the order as per
rules.
