Present: Sh. Ashok Kumar, Ld. counsel for the complainant along with AR.
Ms. Ekta Rai and Mr. Bhavya, Ld. counsel for the accused no.1, 2 and 4 along
with accused no. 2 and 4.
Sh. Dev, Ld. counsel for the accused no.3 along with accused no.3.
Ld. counsel for the complainant submits that no further payment has been
received from the accused and the outstanding amount is Rs.30 lakhs approximately as per
the mediation settlement.
Per contra, Ld. counsel for the accused no.1, 2 and 4 submits that as per the
draft settlement agreement, the outstanding amount is Rs.6 lakhs which the accused is
willing to pay today itself.
Ld. counsel for the complainant submits that complainant is not willing to
settle the matter as per the draft settlement agreement since it is not a final settlement and
same is not signed by the parties.
Since, there is no mutual settlement and the efforts of settlement, both through
mediation as well as out of court has failed, complainant has agreed to return the amount
already received from the accused i.e. to the tune of Rs.72 lakhs through online transfer by
the NDOH.
Put up for compliance and framing of notice on 18.03.2023.
PA is directed to do updation of the case and upload the order as per rules.
