Present: Sh. Varun Samtani, AR for complainant and Sh. Ashok Aggarwal, director of
complainant.
Ms. Ekta Rai, Ld. counsel for the accused no.1, 2 and 4.
Ms. Himanshi, Ld. counsel for the accused no.3 along with accused no.3.
It is jointly submitted that accused has paid an additional amount of Rs.6 lakhs
to the complainant yesterday. That parties have settled the matter for Rs.85 lakhs and now
Rs.7 lakhs is yet to be paid which the accused has undertaken to pay in the next 8 months.
Ld. counsel for the accused undertakes to furnish the settlement agreement
during the course of the day.
AR submits that the matter has been compromised amicably between the parties
and the complainant does not wish to proceed with the matter against the accused and the
complainant has received Rs. 79 lakhs till date towards the present case. The same has been
confirmed by the Director of the complainant. Director as well as the AR requests that the
present complaint be disposed off accordingly.
Separate statement of Sh. Varun Samtani, AR of the complainant has been
recorded and sent to Him through e-mail. The statement is required to be signed by him and
to be scanned and sent back to the Court through e-mail. Duly signed and scanned
statement of the AR of the complainant has been received back through e-mail. Statement
has been digitally signed by the undersigned and the same would form part of the digital
file.//
In view of the statement of the AR of the complainant, the present complaint
case is disposed off as withdrawn. The accused persons are hereby acquitted. Bail
bonds/surety bonds, if any, stands discharged. Original documents, if any, be returned as per
rules.
File be consigned to record room after compliance of due formalities.
PA is directed to do updation of the case and upload the order as per rules.
