Present: Sh. Amit Bajaj, Ld. counsel for the complainant.
Sh. Praveen Singh and Sunil Chaudhary, Ld. counsels for the accused along
with accused no.2.
This is a consolidated order in both the above captioned matters.
Matter is fixed for appearance of accused.
Ld. counsel for the accused undertakes to file his vakalatnama and bail bonds
during the course of the day.
Accused no.2 is directed to file personal bonds and surety bonds in sum of
Rs.80,000/- each separately in both the above captioned matters. Surety to appear on the
NDOH.
Since the present offence is bailable in nature, the accused is admitted to bail
subject to furnishing of personal bonds.
Ld. counsel for the accused further submits that he has not received copy of
complaint and annexed documents.
Ld. counsel for the complainant is directed to do the needful within two days
time.
Ld. counsel for the complainant submits that moratorium has been declared
qua accused no.1. At this stage, Ld. counsel for the complainant has filed relevant order of
Hon’ble NCLT dated 18.10.2022. Ld. counsel for the complainant submit that he is aware
about the said order. In view of the said order, the present proceedings against accused no.1
is stayed till the moratorium is in operation.
Ld. counsel for the accused submits requests that notice may be framed on the
NDOH as accused no.2 is facing connectivity issues today. Heard and considered for today
only. However, accused to ensure proper connectivity in future.
Put up for framing of notice and further proceedings on 03.02.2023.
PA is directed to do updation of the case and upload the order as per rules.
