Matter is fixed for CE today.
Ld. Counsel for the accused has moved an exemption application on
behalf of the accused today stating that the accused is unable to attend the Court
hearing as the niece of the accused has expired. Taken on record.
Heard.
Exemption is allowed for today only subject to oral undertaking by the
Ld. Counsel for the accused that the accused has no objection, if the cross-
examination is conducted in his physical absence and that he will not dispute the
same in future.
Proprietor of complainant/ CW-1 is examined in chief and partly
cross-examined. His further cross-examination is deferred for want of ledger
account.
Ld. Counsel for complainant is directed to provide advance copy of
the above mentioned document to the Ld. Counsel for accused at least 04 days prior
to the NDOH.
Put up for further cross-examination of CW-1 on 19.09.2025 at 02:00
PM.
Both the parties are directed to be physically present on the NDOH for
recording of evidence. Failure to comply with the same will lead to adverse action
against the defaulting party.
Date is given at the convenience of both the parties. No further
adjournment shall be granted.
