Present: Sh. Aditya Puri, Ld. Counsel for complainant.
Accused alongwith Sh. Shobhit Garg, Ld. counsel.
Ld. Advocate for accused submitted that he will mail the memo of appearance,
during the course of the day and the vakalatnama on the next date. Same be so done.
Ld. Counsel submitted that copy of complainant alongwith annexed documents
have been received.
Offence being bailable, accused is admitted to Court bail, subject to furnishing of
bail bond in sum of Rs. 40,000/- with one surety of like amount. Ld. Counsel submitted that no
sound surety is available today and that accused may be permitted to furnish the proper bond on
the next date and personal bond today. Allowed. Personal bond be furnished during the course of
the day and proper bond on the next date.
Ld. Counsel for accused submitted that the accused has paid substantial money
towards the impugned cheque to the complainant as an oral settlement has been arrived at and
now the accused is required only pay Rs. 1.5 lakhs towards the said settlement. Same is also
affirmed by the Ld. counsel for the complainant. Both the Ld. counsels submitted that the
accused has to pay Rs. 1.5 lakhs by 10.04.2022 where after and on the receipt of the said amount,
the complainant shall withdraw the case. Adjournment is sought for the said purpose. Heard.
Allowed.
Put up for furnishing of proper bond/ Vakalatnama/apprising the Court of the
payment/withdrawal/further proceedings on 30.04.2022.
