Fresh complaint case has been received by way of assignment.
Present: Sh. Abhilash Vashisht, Ld. counsel for the complainant.
Arguments heard on the point of summoning.
Ld. counsel for the complainant submits that proposed accused no.4 is the
signatory to the cheque in dispute.
The present complaint is barred by limitation.
The condonation application is already on record.
Notice of the application be issued to the proposed accused. Proposed accused
is directed to appear in person/through counsel on the NDOH. He is at liberty to file a reply
to the application of complainant. In case the proposed accused fails to appear, the
application shall be decided on merits.
Complainant is directed to file a copy of the said application with the Ahlmad
of court within 3 days from today.
The complainant has been apprised of the requirement to submit the complete
original documents (in physical form) of the case including the dishonoured cheque, return
memo, demand notice, dispatch receipt, service of proof, reply, if any etc. apart from
physical signed original complaint, its supporting affidavit and attested affidavit of pre-
summoning evidence with the Ahlmad of this Court. Deposit of these documents being pre-
requisite for taking cognizance in the present case. The complainant is directed to submit the
mandatory Meta-Data form which is available on the website of Digital Court i.e.
delhidistrictcourts.nic.in/DigitalNIActCourtsProject Implementation Guidelines.pdf.
Put up for report/appearance of proposed accused and arguments on
application on 08.05.2023.
PA is directed to do updation of the case and upload the order as per rules.
