Ld. counsel for the accused submits that he has not received the copy of the
complaint.
Ld. counsel for the complainant subits that the same has already been furnished to
the opposite side on the email ID provided by counsel for accused as mentioned in order
dated 29.08.2024 and to substantiate the same he has filed the proof of delivery on the email
Id of the court. Same be taken on record.
On query as to the accused , an oral exemption is sought on behalf of the accused for
today. It is submitted that accused is in his village and is not able to join the VC
proceedings.
It is to be noted that bail bonds have not been furnished as yet despite sufficient
opportunity being given .
Previous cost of Rs.1000/- has also not been paid by accused into the DLSA, PHC,
ND.
Keeping in view the conduct of accused no ground is made out to allow the oral
exemtpion of accused. The exemption stands disallowed.
It is apparent that accused is evading the process of law and his presence can only be
secured through coercive measures.
NBWs be issued against the accused on filing of PF within 07 days from today.
Process be executed through SHO concerned.
Put up for report/ appearance of accused and further proceedings on 02.02.2026.
PA is directed to do updation of the case and upload the order as per rules.
