Perusal of tracking report reflects that the legal notice was returned due to the reason ‘insufficient address’. At this stage, merely by perusing this report, this Court is unable to draw presumption of a deemed service. Therefore, the complainant is directed to file an affidavit of physical verification of address in accordance with the judgment of Hon’ble High Court of Delhi in HDFC Bank Vs. Amit Kumar, 2009 SCC Online Del 1559 in order to establish that the address on which the legal demand notice was sent is correct and the proposed accused was residing at the said address on the relevant date alongwith the proof of address, if any. Perusal of the case documents also reflects that there is a delay of ten days in filing the present complaint. Ld. counsel submit that there was no delay, however, he will verify the same and if need be, he will submit an appropriate application for condonation of delay on the next date of hearing. Allowed. The Ld. counsel is also directed to apprise the court on the outstanding liability as per the accounts statement on the next date of hearing Put up for compliance and further consideration on 24.03.2021.
