Present: Ms. Saroj Tripathi, Ld. Counsel for complainant.
None for accused.
Ld. Counsel for complainant submits that he has filed the tracking report
of the delivery of the summons on the email id of this court.
Same is taken on record.
Physical copy of the same be furnished within due time.
The Reader of this court is directed to upload the same on LAYERS as
per rules.
Perusal of the tracking report shows that summons are duly served on the
accused. Despite service none appeared on behalf of the accused. It appears that
accused is deliberately/intentionally not appearing before this court.
Accordingly, issue bailable warrants against the accused in sum of
Rs. 10,000/- with one surety of like amount on filing of PF, through SHO
concerned, for the NDOH.
The concerned SHO is directed to effect the service of the warrants
positively.
Copy of this order be sent to the concerned SHO through Naib
Court Concerned.
Re-notify for report on warrants/appearance of the accused/framing of
notice/further proceedings on 30.01.2024.
PA is directed to upload the orders as per rules.
