Matter is taken up today on an application moved by the accused.
Present: Ms. Pritika Kaur, Ld. Counsel for the accused along with accused.
An application for cancellation of NBWs has been received on the e-mail ID
of the court. Same be taken on record.
It is stated that accused was unwell due to which he could not appear on the
LDOH. Ld. counsel for the accused submits that she did not have instructions regarding the
matter, due to which she also did not appear. Accused undertakes that he shall appear on
each and every date in future. Ld. counsel also gives her undertaking to let the accused
appear on each and every date in future.
It is noted that no medical report is attached with the application.
Accused is imposed a cost of Rs.1,000/- to be paid to the complainant by the
NDOH.
At request, the NBWs issued on 13.01.2023 is stayed till the NDOH.
Let copy of this order be also sent to the concerned SHO for intimation and
compliance. SHO is also directed to return the process to the court.
Put up for purpose already fixed and date already fixed, i.e. 31.03.2023.
PA is directed to do updation of the case and upload the order as per
rules.
