Present: Sh. Sanjeev Kumar, Ld. Counsel for complainant alongwith AR.
Ms. Sunaina, Ld. Proxy counsel for accused (through VC).
Matter received back from the mediation centre as unsettled. Mediation
order is taken on record.
In lieu of failure of mediation proceedings, the present matter will be
proceeded against the accused person on merits.
Right to cross examine the complainant witness was granted to the
complainant side orally vide order dated 23.11.2023. Today, it is submitted that the
accused alongwith main counsel are not available. Adjournment is sought on the
same ground.
Heard. Adjournment granted subject to cost of Rs.5000/- to be deposited
in Advocate Welfare Fund, PHC, ND on the NDOH. It is further clarified that if the
accused fails to appear on the NDOH for any reason whatsoever, right of the accused
to cross examine the complainant witness will be closed.
Put up for CE on 24.07.2024 at 2:00 PM.
Both the parties are directed to appear physically at PHC, New Delhi on
the NDOH.
PA is directed to upload the orders as per rules.
