Perusal of record shows that accused was directed to be present in person for furnishing bail bonds & surety. Multiple opportunities have been given to the accused to settle the matter/cross examine the complainant witness. Till date no settlement has been placed on record. Ld. counsel for complainant states that no settlement could take place between the parties. Today also accused has not appeared in person. Ld. counsel for accused has also not appeared for cross-examination. Therefore, to secure the physical appearance of the accused, issue NBWs against the accused (on filing of PF within 30 days from today) through SHO concerned, returnable on NDOH. Ld. counsel for complainant states that the AR has been changed. Application for substitution of AR be filed on NDOH along-with evidence by way of affidavit.
