The matter is at the stage of cross examination of the AR of the
complainant under Section 145 (2) of NI Act but Ld. Counsel for complainant
submits that AR is not available today owing to some personal family issue, so a
short adjournment may be given.
Same is opposed by Ld. Counsel for accused.
Heard. Adjournment granted, subject to last and final opportunity and
cost of Rs. 1000/- to be paid in DLSA/ND.
If the AR for complainant or his counsel fails to appear on the NDOH, the
accused will be acquitted under Section 256 of Cr.P.C for non appearance of complainant on
material stages of the trial as per the recent judgment of Hon’ble Supreme Court of India.
Put up for cross examination of the AR of the complainant under
Section 145 (2) of NI Act on 10.11.2023 at 2:00 pm.
Both the parties are directed to appear physically at PHC, New
Delhi.
PA is directed to upload the orders as per rules.
