The present Criminal Revision Petition under Section
397 Cr.PC is received. It be checked and registered.
Present: Sh. Pankaj Singh and Sh. Manish Sangwan, Advocates
for revisionist.
Heard on the present revision petition under Section 397
Cr.PC and perused the record.
The petitioner/revisionist/accused is assailing the order
dated 27.10.2022 whereby the Ld. MM has allowed the request of CWs
1&2 to rely on their presummoning evidence after taking cognizance of
the matter in order to record evidence for precharge stage.
Ld. Counsel for the revisionist has relied upon the decision
in Sunil Mehta v. State of Gujarat (2013) 9 SCC 209. Much is urged
that the impugned order is in violation of Section 244 and 245 Cr.PC.
The issue requires deeper examination.
Let notice of the present revision petition be issued to the
respondent/ complainant and his counsel on filing of PF, dasti, for
15.02.2023. Till then, the proceedings before the Ld. Trial Court shall
remain in abeyance.
Copy of this order be sent to the Ld. Trial Court for
information and necessary compliance.
