The affidavit and ITR have not been filed by the respondent
no. 2 in terms of previous order dated 03.06.2026. It is submitted by Ld.
Counsel for respondent no. 2 that he needs some time to verify from the
respondent no. 2 as to how many cases have been filed by him under section
138 NI Act. He also undertakes to place on record the ITR of the respondent
no. 2 on NDOH.
Submissions heard. Record perused.
On LDOH, this Court had passed clear directions to the
respondent no. 2 to file affidavit and ITR and ample time was granted to
respondent no. 2 for a period of 03 months.
Now, adjournment is again sought to comply with the
previous order. It is a deliberate attempt on the part of respondent no. 2 to
delay the proceedings, therefore, he is burdened with the cost of Rs. 2000/-
to be deposited in DLSA, PHC, New Delhi and receipt of the same be
placed on record on NDOH. He is directed to comply with previous order on
or before NDOH.
