Written statement, affidavit of admission and denial of
documents, application under Section 151 CPC for delay condonation
alongwith Valakatnama has been filed on behalf of the defendant. Copy has
already been supplied.
It is submitted by Ld. Counsel for the defendant that the
defendant herein was out of station and due to holidays on account of
Diwali and Dushehra vocations, they could not get proper instruction from
his client and written statement could not be filed in time. She further prays
that the written statement may be taken up on record and the delay in filing
the same may kindly be condoned.

Ld. Counsel for the plaintiff at this juncture, fairly concedes
that for an expeditious disposal of the instant case, written statement be
taken on record subject to cost.
In view of the same, written statement filed on behalf of the
defendant is taken on record subject to cost of Rs.3000/- to be paid to the
plaintiff.
Replication, if any be filed within 4 weeks from today
alongwith affidavit of admission and denial of documents with advance
copy to the other side.
Now to come up for replication, admission and denial of
documents and framing of issues on 03.03.2025.
Admission and denial of documents be conducted by way of
affidavit and same be exchanged by the next date of hearing.
