Counsel for Defendant (through VC).
Counsel for the plaintiff seeks a short adjournment
submitting that his clerk has gone to deposit the cost imposed
upon the plaintiff on 29.07.2025 and he also seeks a short
adjournment submitting that an amendment application is
required to be moved in the instant matter.
Counsel for the defendant strongly opposes the
adjournment plea submitting that eversince 22.07.2025 when the
preliminary issues were framed, the plaintiff is avoiding to
address arguments. It is forcefully argued that the suit ought to be
dismissed for non-prosecution. It is submitted that if at all the
amendment application is required to be moved, the same should
have been moved in advance. Accordingly, counsel for the
defendant prays for dismissal of suit for non-prosecution.
In the interest of justice, one more opportunity is
given to the plaintiff subject to cost of Rs.25,000/- to be
deposited with Lawyers Welfare Fund, New Delhi District.
To come up for arguments on preliminary issues in
the matter on 23.07.2026.
