Sh. Arun Singh, Ld. counsel for defendants.
One replication alongwith reply to application of
defendant filed for the purpose of seeking to refer the case to
Mediation and one application to take some additional documents
on the record filed on behalf of plaintiff. Copy of replication, reply
and the application supplied to the counsel for defendant.
One application under Order VII Rule 11 CPC was
filed taking objection against territorial jurisdiction of this court.
The objection against territorial jurisdiction cannot be maintained
under Order VII Rule 11 CPC. Hence, that application is dismissed
being not maintainable.
Submissions heard on the application of defendant to
refer this matter to Mediation Centre. With consent of counsel for
plaintiff, matter is referred to Mediation Centre, Patiala House with
advice to both the parties to participate in the same with genuine
and honest efforts. Requisite format shall be signed by both the
counsels.
Both parties shall appear before Ld. Officer-In-Charge,
Mediation Centre, Patiala House Courts today at 02:00 PM and
parties shall appear back before this court on 13.03.2026.
