Present: Sh.Sumet Singh Ld. counsel for plaintiff through
video conferencing.
None for defendant.
Pleadings in the matter are complete. Both plaintiff
and defendant have filed their proposed issues.
From the pleadings of the parties following issues are
framed:
1. Whether the plaintiff did not supply the fruits to the
defendants, as per the orders placed by the defendants and
the fruits supplied were not of the assured quality? If so its
effects? OPD.
2. Whether the plaintiff is entitled for recovery of the suit
amount of Rs.23,89,249/- as prayed for? OPP.
3. Whether the plaintiff is entitled for interest on the
aforesaid amount? If so at what rate and for which period?
4. Relief, if any.
No other issue arises or pressed for. Both parties shall
file list of their witnesses within 10 days. Plaintiff shall file
affidavit of its witnesses at least one week prior to the next date
of hearing with advance copy to the opposite party.
Defendant shall also file affidavits of its witnesses at
least one week prior to the date of commencement of defendant’s
evidence with advance copy to the opposite party.

Case Management hearing
• Case shall be taken up for plaintiff's evidence on
14.09.2026, 15.09.2026 and 17.09.2026.
• Case shall be taken up for defendant’s evidence on
05.10.2026, 06.10.2026 and 07.10.2026.
• Final arguments shall be heard on 23.10.2026.
Both parties shall ensure that all the steps are taken
in advance in order to lead and complete evidence on aforesaid
dates.
