M/S DEV BHUMI COLD CHAIN PVT. LTD. v. GREEN
FRESH AGRO PRODUCTS AND ORS.
15.05.2026 (At 11:32 a.m.)
Present: Sh. Ankit Dang, ld. counsel for plaintiff.
None for defendants.
1. Arguments heard on application under Order XI Rule 1 CPC, as
moved by plaintiff, in order to file additional documents. No one
has appeared for the defendants to make any submission on this
application.
2. As per this application and arguments of ld. counsel for plaintiff,
defendants in their common Written Statement denied the
delivery of products as per invoices referred in paragraph-6 of
the plaint. Therefore, in order to furnish proof of delivery of the
products/fruits, plaintiff wants to place on the record the copy of
gate passes obtained from cold storage, in order to show the
delivery of fruits.
3. I have perused paragraph-6 of the plaint, wherein plaintiff has
referred to three invoices alleging that despite delivery of fruits
against these invoices, defendant did not make payment against
the same. In paragraph-5 of the WS, defendants have denied the
correctness of contentions made in the plaint in respect of afore-
said invoices. In these circumstances, I do find it appropriate to
allow this application and to take the additional documents on the
record, which are in the nature of photocopies of gate passes
issued by different cold storages. However, plaintiff shall be
required to prove the same in accordance with law. Application is
allowed accordingly.

management hearing.
