The defendant no. 2 is not appearing despite being
served by way of publication in the newspaper on 22.01.2025
and 23.01.2025. WS has also not been filed by the defendant
no. 2. Hence, the defendant no. 2 is proceeded ex-parte and right
to file the WS is also closed.
The plaintiffs have not filed reply to the application
under Order 1 Rule 10 (2) CPC moved by the defendant no. 6.
Proxy Counsel for the plaintiff submits that she will argue on the
application straightaway. She seeks an adjournment for
arguments on the pending applications i.e. under Order 7 Rule 11
CPC of the defendant no. 1 and under Order 1 Rule 10 (2) CPC
of the defendant no. 6.
