Sh. Santosh Kumar Pandey, Counsel for defendant no.5/DJB.
AE Sh. Rajiv Jain submits that he will search for the site plan.
Heard. Considered.
Let him search and positively give an answer on the next date of
hearing. In the meantime, AE Sh. Rajiv Jain is also directed to inspect the building
broadly and point out the deviations any substantial construction, which is contrary
to the norms as on date. He is also directed to inspect the property wholly and not a
restricted portion of defendant no.2 with further direction to complete the process
within six weeks from today.
At this stage, counsel for the plaintiff submits that defendant no.1 may
be directed not to create any third party interest in the property.
Counsel for defendant no.1 submits that defendant no.1 is present in the
court and he will assure that he will not do so. Her submission made at bar is taken on
record.
Re-list the matter for 19.09.2024 for report/further proceedings.
