Plaintiff.
Summons which were sent to the defendants on the
application of the applicant/plaintiff under Order IX Rule 4 r/w
Section 151 CPC have been received back with remarks “left/no
such person”.
Ld. Counsel for plaintiff submits he has taken more
than appropriate steps which were required for the service of the
opposite parties on the present application.
In the facts and circumstances for the reasons
mentioned in the application, the order of dismissal of the suit
dated 14.11.2022 is hereby set aside and suit is resorted to its
original number and position. Application of applicant/plaintiff
stands disposed off.
As per order dated 12.10.2022, defendants were
served by publication in newspaper on 12.07.2022.
Ld. Counsel for plaintiff submits he needs time to go
through the case file regarding status of the service of the
defendants. Time granted in the interest of justice.
