The present appeal has been filed under Section 415(i)(a)
of BNSS, 2023 assailing judgment dated 15.07.2025 and order on
sentence dated 21.07.2025 passed by Ld. JMFC (NI Act-03), West
District, Delhi in CC No. 41114/2016 titled as Arjun Kohli Vs. Vishal
Prajapati, whereby appellant was convicted for the offence under
Section 138 NI Act and sentenced to go simple imprisonment for a
period of six month which shall run concurrently in CC Nos.
28478/2016, 4113/2016, 41114/2016 and 41596/2016. He was further
sentenced to pay fine of Rs.1,50,00,000/- in each CC 28478/2016,
4113/2016, 41114/2016 and 41596/2016 to the complainant as
compensation within 120 days from and in default of payment of fine,
he shall undergo simple imprisonment for six months which shall run
consecutively in CC No. 28478/2016, 4113/2016, 41114/2016 and
41596/2016 and the same shall be recoverable as per provision of
Section 421 Cr. PC.
2. An application under Section 5 of the Limitation Act
seeking condonation of delay in filing the present appeal has also been
filed along with present appeal. Ld. Addl. PP for the State accepts
notice of the application.

3. Heard. Record perused.
4. Issue notice of the application to respondent No. 2 subject
to filing of PF/RC, for the next date of hearing.
5. Put up for appearance of respondent No. 2, reply and
arguments on aforesaid application on 08.12.2025.
