Section 151 CPC for restoration of the present matter is pending
on record.
No reply to the abovementioned application filed by
the respondents, however, application has been opposed verbally.
Submissions heard. Record perused. There is delay
of about 02 years in moving the present application, however,
considering the reason given in the application and the fact that
M.V.Act is a benevolent legislation, I am inclined to condone the
delay. The application is allowed and petition is restored to its
original number subject to the rider that petitioner shall not be
entitled to the interest liability during the period from the date of
dismissal of petition till its restoration.
At this stage, it is jointly submitted that there are
chances of amicable settlement between the parties.
Let the matter be fixed for pre Lok Adalat sitting on
05.03.2024.
