It is submitted on behalf of the defendant that affidavit of
admission and denial of documents had been filed on 24.08.2022, itself,
alongwith the written statement. Heard.
Record perused.
The affidavit of admission and denial of documents filed on
behalf of the defendant is on record. Therefore, order dated 08.07.2024 to
the extent of imposition of cost upon the defendant is withdrawn as an
inadvertent error had occurred.
On the basis of affidavit of admission and denial of documents
of the parties, only copy of settlement dated 20.07.2018 stands admitted (by
the plaintiff) and the same is now Ex. A-1.
On the basis of the pleading, the Court hereby frames the
following issues:
1. Whether the plaintiff is entitled to a decree for recovery of
Rs.2,32,015/- plus Rs.73,470/- (amounting to Rs.3,05,405/-) in view of
MOU dated 28.11.2017? OPP.
2. If yes, whether the plaintiff is entitled to interest and at what rate?

3. Whether the suit is barred by limitation? OPD
4. Relief
No other issue arises or is pressed for.
