Present: Sh. Ashok Kumar Goel, Ld. Counsel for the
appellant along with appellant in person.
Sh. Indrachand Prajapati, Ld. Counsel for the
respondent has joined through VC.
Ld. Counsel for the appellant submits that in
accordance with order datd 30.11.2024, he has deposited the
FDR and furnished the personal and surety bonds before the Ld.
Trial Court.
However, TCR is not received and so, the said
submissions cannot be confirmed.
Issue bailable warrants in the sum of Rs.5,000/-
against the Ahlmad of the Ld. Trial Court with directions to file a
written explanation for the reasons for non compliance of the
previous order and to produce the TCR on the next date of
hearing.
Ld. Counsel for the respondent submits that he has
not received the copy of this appeal. Accordingly, appellant is
directed to supply the same to ld. Counsel for the respondent
within a week from today.
At this stage, it is jointly submitted by both the
parties that they want to settle the present matter. In the facts and
circumstance of the present case, I am of the considered opinion
that there is an element of settlement between the parties.

Accordingly, the matter is referred to the Mediation
Center. Both the parties are directed to appear before the
Mediation Center, New Delhi District, Patiala House Courts,
New Delhi for exploring the possibilities of settlement on
15.02.2025 at 2 pm.
Put up for awaiting report of settlement, if any, from
the Mediation Center otherwise for reply and arguments on this
appeal on 21.04.2025.
