This is an application for grant of regular bail
moved on behalf of applicant / accused Saji Mathew.
Present: Sh. Satish Aggarwal, Ld. Sr. Standing Counsel for
the Department alongwith Ms. Neha Aggarwal, Ld.
Counsel.
Sh. Naveen Kohar and Sh. Lakshya, Ld. Counsels
for the applicant.
Ld. Sr. Standing Counsel for the Department submits
that order dated 20.03.2026 whereby bail application on the
ground of parity with accused Vansh Sadana is granted to Manuj
Chhabra and Jai Prakash, the same is pending consideration
before Hon’ble High Court and under challenge. The Ld. Sr.
Standing Counsel has also present copy of order CRL.M.C.
2475/2026 titled Customs (Preventive) Vs. Manuj Chhabra dated
04.04.2026 and CRL.M.C. 2484/2026 titled Customs
(Preventive) Vs. Jai Prakash dated 04.04.2026. He further
submits that when the earlier orders are pending consideration
before Hon’ble High Court, the present court should not proceed
with the hearing of the present application on the ground of
parity and on merits, he seeks time to brought on record copy of

bail application and order passed by Ld. CJM with regard to co-
accused Sushma Jain. Lastly, he submits that he will file the
relevant documents in addition to the reply within 02 days from
today.
Looking to the fact that the ground of parity is not
the sole ground in the present matter as the same is challenged
before the Hon’ble High Court, all the relevant facts which are
going to be produced by Ld. Sr. Standing Counsel shall be
considered at the time of hearing of the application.
Put up for arguments on 10.04.2026.
It is made further clear that this is the last and final
opportunity for hearing the present matter. Ld. Sr. Standing
Counsel is directed to do the needful positively on or before the
NDOH.
