Heard. Perused.
WS of defendant no.1 & 2 and were e-filed on
09.02.2026, however, no affidavit qua admission and denial of
documents of the plaintiff was filed by the said defendants.
Counsels for both the defendants undertake to file the same
within one week, to which counsel for plaintiff has no objection.
Advance copies thereof be supplied to Ld. Counsel for plaintiff.
WS and reply to application under Order XXXIX R.1
& 2 Read with Section 151 CPC was filed on behalf of the
defendant.
Replication and rejoinder to the aforesaid application
was e-filed by the plaintiff and hard copies thereof were placed
on the judicial file. Counsel for defendants have admitted that
copies thereof have already been received by them.
Counsel for plaintiff seeks and is granted last
opportunity to file reply to the pending application under Section
VII Rule 11 CPC of the defendant no.2 within one week with
advance copy thereof be supplied to Ld. Counsel for defendant
no.2 who may file rejoinder thereto, if any, before next date of

hearing with a copy thereof be supplied to Ld. Counsel for
plaintiff.
Ld. Counsel for defendants have accepted the notice
of the pending application under Section 12A(1) of the
Commercial Court Act Read with Section 151 CPC of the
plaintiff while admitting that they have already received copies
thereof.
At request reply thereto may be filed before next date
of hearing.
Re-notify for arguments on all the pending
applications on 28.09.2026.
Date is given as per convenience of counsels for
parties.
