Heard on account of maintainability of present suit.
Ld. Counsel for plaintiff submits that present suit is maintainable
in this Court as the plaintiff has prayed to restrain defendants from
using, marketing, trade secrets etc. of products of plaintiff.
Heard. Considering the fact that both defendants through their
ld. counsel have appeared in the Court and already filed their respective
Vakalatnama s, it would be appropriae if this fact is decided later on at
appropriate stage.
Formal notice of present suit has not yet been issued. However,
since notice of present suit has been accepted by ld. Counsel for both
defendants, both defendants deemed to be served today. Copies of
complete set of plaint stated to have already received.
Let written statement be filed by both defendants within
stipulated period alongwith reply to application U/o XXXIX Rule 1 &
2 CPC with advance copies to plaintiff. On receipt of copies, plaintiff
may also file replication, if any, by NDOH with advance copy to
defendants.
Put up the matter for completion of pleadings, admission-denial
of documents, framing of formal issues as well as for argumnets on
injunction application, on 20.02.2026. However, at joint request date
given stand changed to 27.02.2026. Date given earlier i.e. 20.02.2026
stands canceled.
