Present: Ms. Manisha Baruah (appearing through V/C), ld.
counsel for Award Holder.
An application u/s. 39 and 40 CPC was filed on
behalf of Award Holder to furnish new address of Award Debtor,
which is stated to be situated in South West District, Delhi. In the
same application, prayer has been made to transfer the execution
petition or to issue necessary transfer certificate. Heard and
perused.
In the case of Daelim Industrial Co. Ltd. v.
Numaligarh Refinery Ltd., 2009 SCC OnLine Del 511, Hon'ble
High Court of Delhi, has already clarified that in respect of
Arbitral Award there is no necessity and requirement to issue
transfer certificate. Award Holder is at liberty to approach the
concerned court directly with fresh execution petition. Hence,
this application is to be rejected and execution petition is also
disposed of with liberty to the Award Holder to approach the
concerned court with fresh execution petition.
File be consigned to record room after due
compliance.
