This is upon an application U/s 439 Cr. PC filed on
behalf of accused/applicant Prem Ratan Sharma for grant of
interim bail/extending interim bail already granted to the
accused/applicant.

Submissions heard. Perused.
It is submitted inter alia by Ld. Counsel for
accused/applicant that vide order dated 14.10.2023, Ld. ASJ/Special
Judge, NDPS/Bail Roster Judge, New Delhi District, granted interim
bail to the accused/applicant for a period of 15 days from the date of
his release, on the ground of surgery of mother of accused/applicant. It
is further submitted that surgery of mother of accused/applicant is yet
to be conducted and the presence of accused/applicant is required to
take care of his ailing mother, hence, it is requested to extend the
interim bail for a period of 30 days.
Application under consideration is opposed by Ld. Addl.
PP for State as well as by Ld. Counsel for complainant.

During the course of arguments, Ld counsel for
accused/applicant submits that surgery of mother of the
accused/applicant is now scheduled for 28.10.2023 and interim bail
period already granted to the accused/applicant vide order dated
14.10.2023, is going to expire on 29.10.2023 and it is therefore,
requested that interim bail of the accused/applicant may be extended
for two more days till 31.10.2023, so that accused/applicant can take
care of his ailing mother.
Having considered the submissions made at bar,
considering the totality of circumstances and purely on humanitarian
grounds, the interim bail of accused/applicant Prem Ratan Sharma
already granted vide order dated 14.10.2023, is extended till
31.10.2023, on the personal bond and surety bond already furnished as
well as subject to the same terms and conditions as contained in the
order dated 14.10.2023.
Application is disposed of accordingly.
Copy of order be given dasti to ld. Counsel for the
accused.
Copy of this order be also sent to ld. Trial Court.
