Ld. Counsel for the appellant submits that vide order
dated 30.03.2026, Hon’ble High Court of Delhi has directed this Court
to consider the application (referring to application under Section 101
& 102 of NDMC Act filed by the appellants). It is submitted that the
application under Section 101 & 102 of NDMC Act be heard for
disposal.
Ld. Counsel appearing for NDMC has submitted that
earlier the matter was heard on the point of limitation, however, the
order could not be passed. It is submitted that the appeal is filed after a
long delay and therefore, the issue of limitation may be decided. Ld.
Counsel has submitted that in view of the specific direction of
Hon’ble High Court of Delhi, the application under Section 101 & 102
of NDMC Act be taken for disposal first.
Arguments heard from both the sides on the said
application.
Vide separate order pronounced in the open court today,
the application filed under Section 101 & 102 of NDMC Act is
disposed off.
Put up for arguments on application seeking condonation
of delay in filing appeal filed by the appellant on 07.10.2026.
