Ld. counsel for the defendant submits that he does
not wish to press the application under Order XI Rule 1(10) r/w
Order VIII Rule 1A CPC to bring on record additional documents,
with liberty to file fresh application. Statement of ld. counsel for
defendant recorded separately to this effect.
In view of statement made by ld. counsel for the
defendant, above-said application is dismissed being not pressed
for with liberty as prayed in accordance with law. Accordingly,
application stands disposed of.
PW1 Aseem Kapoor is further examined-in-chief and
partly cross-examined on behalf of the defendant and his further
cross-examination is deferred today for production of certain
document on next date of hearing.
It is noted that there are further two dates fixed for
conclusion of evidence. Hence, in the event the evidence is not
concluded by the parties as per calendar fixed by the court, the case
shall be put up before Local Commissioner for completion of
evidence.
At this stage, ld. counsel for the defendant requests
that matter be taken up on 17.09.2026 instead of date already fixed

i.e. 16.09.2026. Ld. counsel for plaintiff does not object change of
date.
At request, renotify the matter for further cross-
examination of PW1 on 17.09.2026. Date already fixed i.e.
16.09.2026 stands cancelled.
