It is stated by the learned counsel for the defendant
that copy of paperbook has not been supplied to him by his client.
Accordingly, a set of unserved paperbook kept on record along
with the summons is supplied to learned counsel for defendant
today.
Written statement be filed within stipulated period.
Alongwith the written statement, the defendant shall also file any
affidavit of admission/denial of documents of the plaintiff,
without which, the written statement shall not be taken on record.
Liberty is given to the plaintiff to file replication
within 30 days of receipt of the written statement. Alongwith
replication, if any, filed by the plaintiff, an affidavit of
admission/denial of documents of defendant be filed by the
plaintiff, without which, the replication shall not be taken on
record.
Renotify the matter for completion of pleadings,
admission/denial of documents and marking of exhibits of
documents as well as framing of issues on 16.02.2026.
